The recent updates by Immigration, Refugees and Citizenship Canada (IRCC) have revised the eligibility requirements for Spousal Open Work Permits (SOWP).

Effective March 19, 2024, partners and spouses of international students are now only eligible for a SOWP if their sponsor is enrolled in a master’s or doctoral degree program at a university or polytechnic institution in Canada. Exceptions exist for spouses of undergraduate students in specific professional degree programs like Doctor of Dental Surgery (DDS, DMD).

Applicants must provide proof of their relationship to the student and evidence of their partner's enrolment in a degree-granting program. Those who applied for a SOWP before March 19 remain eligible under certain conditions. Spouses and partners who are no longer eligible for a SOWP can apply for other work permits or a visitor visa. The changes aim to address challenges related to volume and integrity issues in the program.
